GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

PREAMBLE
These General Terms and Conditions of Sale (hereinafter "GTCS") govern all contractual relations between:
On the one hand,
The sole proprietorship Atelier PixScriptum, represented by Moutrous EI, acting as an author artist / micro-entrepreneur.

(Hereinafter referred to as the "Seller")
And on the other hand,
Any natural or legal person purchasing via the Atelier PixScriptum website (hereinafter the "Site").
(Hereinafter referred to as the "Customer")
The Customer declares to be a natural person of legal age (over 18) and to have full legal capacity to contract.
ARTICLE 1: OBJECT, SCOPE AND DURATION
1.1. Object
The purpose of these GTCS is to define the rights and obligations of the parties in the context of the online sale of products proposed by the Seller (Art Prints, Posters, Digital Files).
1.2. Scope
They apply without restriction or reservation to all sales concluded by the Seller with non-professional buyers (consumers), wishing to acquire the products proposed on the Site.
The Seller reserves the right to adapt or modify these GTCS at any time. In case of modification, the GTCS in force on the day of the order will be applied to each order.
1.3. Territory
The products are offered for sale for delivery worldwide, subject to the areas served by the Seller's logistics partners.
ARTICLE 2: PRODUCT CHARACTERISTICS
2.1. Nature of products
- Printed Artworks (Print on Demand): Posters and prints produced exclusively to order.
- Digital Content: Image files (PNG/JPG) for download for strictly personal use.
2.2. Print on Demand (POD)
The Seller draws the Customer's attention to the fact that physical products are not stocked ("just-in-time"). Each order triggers a unique and custom manufacturing process by printing partners located geographically closest to the Customer to optimize delivery and reduce carbon footprint.
2.3. Availability
Product offers are valid as long as they are visible on the Site. In the event of exceptional unavailability of raw materials (paper, ink) at the printing partner after placing an order, the Seller will inform the Customer by email. The order will then either be cancelled and refunded immediately, or put on hold according to the Customer's choice.
2.4. Conformity and visual rendering
The products are described with the greatest possible accuracy (paper weight 192-200 g/m², museum quality).
Important warning:
The colors of the visuals displayed on the Customer's screen (RGB colorimetry, backlighting) may differ slightly from the colors of the final printed product (CMYK colorimetry, matte paper). These technical variations inherent in printing processes and Customer screen settings cannot engage the Seller's liability nor constitute a lack of conformity.
ARTICLE 3: PRICE
Prices are indicated in Euros (€).
3.1. VAT
The Seller is subject to VAT. The displayed prices include VAT applicable at the current rate.
3.2. Shipping costs
Shipping costs are free for the following geographical areas: France, European Union, United Kingdom, USA, Canada, Australia, Japan, New Zealand. For any other destination, shipping costs are indicated before order validation.
3.3. Customs and Import Taxes
For deliveries outside the European Union, customs duties, import taxes or local taxes may be payable upon arrival of the package at destination. These duties and sums are not the responsibility of the Seller. They are the sole responsibility of the Customer and are their entire responsibility, both in terms of declarations and payments to the competent authorities of their country. The Seller advises the Customer to inquire with local authorities.
ARTICLE 4: ORDER
4.1. Order process ("Double Click")
The order can only be registered on the Site if the Customer has clearly identified themselves. The order process respects the law on confidence in the digital economy ("double click" process):
- Selection: The Customer adds products to the cart.
- Verification: The Customer checks the details of their order (product, price, contact details) and corrects potential errors.
- Validation: The Customer validates their order by clicking on the "Pay" button (or similar wording confirming the payment obligation).
- Payment: The Customer proceeds to secure payment.
4.2. Confirmation
The sale will only be considered final after the Seller has sent the Customer confirmation of the acceptance of the order by email. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order.
4.3. Proof and Archiving
The computerized registers, kept in the computer systems of the Seller and its partners, will be considered as proof of communications, orders, and payments between the parties. Archiving of order forms and invoices is carried out on a reliable and durable medium. In accordance with Article L. 213-1 of the Consumer Code, for any order of an amount greater than 120 euros, the Seller ensures the preservation of the writing stating the contract for a period of 10 years and guarantees access to the Customer if they request it.
ARTICLE 5: PAYMENT
Payment is due immediately upon ordering, including for pre-order products.
5.1. Payment methods
Payment is made by credit card (Visa, MasterCard, American Express, etc.) via the secure Stripe platform.
5.2. Transaction security
Transactions are secured by the SSL (Secure Socket Layer) protocol via Stripe. The Customer's banking details are encrypted and never transit in clearing on the network. The Seller has no access to any confidential banking information.
5.3. Late or refused payment
In case of refusal of payment authorization by credit card from officially accredited organizations or in case of non-payment, the order will be automatically cancelled.
ARTICLE 6: DELIVERY
6.1. Deadlines
Products being manufactured on demand, average deadlines are:
- Manufacturing: 1 to 4 business days.
- Delivery: 2 to 7 business days depending on destination.
- Digital products: Delivery by email within 12h.
The delivery deadline is set, for an address in Metropolitan France, at 30 days maximum after the order. After this period, and except in cases of force majeure, the Customer may request the cancellation of the sale in accordance with articles L.216-2 and following of the Consumer Code.
6.2. Transfer of risk
The transfer of ownership of the Seller's products, to the benefit of the Customer, will only be realized after full payment of the price by the latter. Whatever the date of the transfer of ownership of the products, the transfer of risks of loss and deterioration relating thereto, will only be realized at the moment when the Customer physically takes possession of the products.
6.3. Delivery anomalies (Damage, Missing Parcel)
The Customer is required to verify the state of the packaging and the conformity of the delivered products upon receipt. In case of damaged parcel or deteriorated product:
- The Customer must imperatively issue clear and precise reservations on the carrier's delivery slip if possible.
- The Customer must inform the Seller by email (contact@pixscriptum.art) within a maximum period of 3 business days following receipt.
- The Customer must provide probative photos of the damaged product AND the packaging (visible label).
After validation of the damage by the Seller, a replacement product will be shipped at the Seller's expense. No refund will be made if replacement is possible.
ARTICLE 7: RIGHT OF WITHDRAWAL
7.1. Exclusion for Physical Products (Print on Demand)
In accordance with Article L.221-28 3° of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized.
Posters sold by Atelier PixScriptum being printed specifically at the Customer's request (format, visual) and not constituting standard stock, they fall within the scope of this exclusion.
7.2. Exclusion for Digital Products
In accordance with Article L.221-28 13° of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium whose execution has begun before the end of the withdrawal period and, if the contract subjects the consumer to an obligation to pay, where:
- a) They have given their prior express consent for the execution of the contract to begin before the expiration of the withdrawal period;
- b) They have acknowledged that they will lose their right of withdrawal;
- c) The professional has provided confirmation of the consumer's agreement.
By validating their digital file order, the Customer expressly waives their right of withdrawal.
ARTICLE 8: LEGAL GUARANTEES
The Seller is liable for lack of conformity of the goods to the contract under the conditions of Article L. 217-4 and following of the Consumer Code and for hidden defects of the thing sold under the conditions provided for in Articles 1641 and following of the Civil Code.
LEGAL BOX (French Law)
When acting under the legal guarantee of conformity, the consumer:
- benefits from a period of two years from the delivery of the goods to act;
- may choose between repair or replacement of the goods, subject to the cost conditions provided for by Article L. 217-9 of the Consumer Code;
- is exempted from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following the delivery of the goods.
The legal guarantee of conformity applies independently of any commercial guarantee eventually granted. The consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and in this hypothesis, they can choose between the cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
ARTICLE 9: INTELLECTUAL PROPERTY AND USAGE LICENSE
9.1. Copyright
All elements of the Site, visuals, images, texts and artistic works sold are the exclusive intellectual property of Sarah Moutrous, creator of Atelier PixScriptum. They are protected by international copyright law.
9.2. Usage License for Physical Products
The purchase of a poster grants the Customer the right to display the work in a private setting (family circle) or professional setting (office decoration). Any reproduction or resale is prohibited.
9.3. Usage License for Digital Products (Files)
The purchase of a digital file grants the Customer a personal, non-exclusive and non-transferable license.
Authorized:
- Print the file for personal use (home decoration).
- Have the file printed by a local lab for personal use.
Strictly Prohibited:
- Resell the digital file or share it for free online.
- Use the file for commercial purposes (advertising, logo, derivative products).
- Upload the file to Print-on-Demand sites (Redbubble, Society6, etc.) for profit.
- Modify or alter the work to claim it as one's own.
Any violation of these rules will be subject to legal proceedings.
ARTICLE 10: LIABILITY
The Seller's liability cannot be engaged in the following cases:
- Non-compliance with the legislation of the country where the products are delivered. It is up to the Customer to check with local authorities on import possibilities.
- Misuse of the product, negligence or lack of maintenance by the Customer (ex: displaying a poster in direct sunlight or in a humid room altering colors).
- Inconveniences inherent to the use of the Internet network (service interruption, virus, etc.).
- Force majeure (strike, natural disaster, pandemic).
ARTICLE 11: PERSONAL DATA AND BLOCTEL
11.1. Personal Data
The collected data is necessary for processing the order and issuing invoices. They may be communicated to the Seller's partners responsible for the execution, processing, management and payment of orders (notably Stripe and printing partners).
The Customer has a permanent right of access, modification, rectification and opposition regarding information concerning them.
11.2. Opposition to telephone canvassing (Bloctel)
If the Customer's telephone number is collected during the creation of their account or the placing of their order, the Seller informs the Customer of their right to register on the "Bloctel" telephone canvassing opposition list, in accordance with Article L.223-2 of the Consumer Code.
ARTICLE 12: DISPUTE RESOLUTION AND MEDIATION
12.1. Complaint
For any complaint, the Customer is invited to contact the Seller by email at contact@pixscriptum.art to try to find an amicable solution.
12.2. Mediation
In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, the Seller offers a consumer mediation device.
The retained mediation entity is: [MEDIATOR NAME] (ex: CNPM - MÉDIATION DE LA CONSOMMATION).
(Note: Adhesion to a mediator is a legal obligation in France. Contact CNPM or similar bodies).
12.3. European Online Dispute Resolution Platform (ODR)
In accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union. ARTICLE 13: APPLICABLE LAW AND LANGUAGE
These GTCS and the operations resulting from them are governed by and subject to French law.
These GTCS are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
